Terms of Service

1. Purpose

These Terms of Service govern the contractual relationship between BraizeRecords and its clients in connection with the provision of music distribution, promotion, production, and other music-related services.

2. Services Offered

BraizeRecords offers the following services:

  • Digital and physical music distribution
  • Label services
  • Marketing and promotion
  • Recording studio
  • Mixing and mastering
  • Music synchronization
  • Publishing and rights management

3. Pricing

Our service rates are available upon request and may vary depending on:

  • The type of service requested
  • The contract duration
  • The volume of music to be distributed
  • Additional options selected

All prices are stated in euros, excluding taxes unless otherwise stated.

4. Order and Acceptance

Any order for services implies acceptance without reservation of these Terms of Service. The order is final only after:

  • Signature of a service agreement
  • Payment of deposit or full amount according to agreed terms
  • Provision of all necessary elements (masters, artwork, metadata, etc.)

5. Payment

Payment Methods

Payment may be made by:

  • Bank transfer
  • Credit card
  • Automatic debit (for recurring contracts)

Payment Terms

  • Deposit : 30% upon order
  • Balance : upon delivery or according to agreed schedule

Late Payment

In case of late payment, penalties of 3 times the legal interest rate will be applied, as well as a fixed indemnity of 40€ for collection costs.

6. Rights and Intellectual Property

Client Rights

The client guarantees that they hold all necessary rights to the works entrusted to BraizeRecords. They guarantee in particular:

  • Being the author or having obtained all necessary author rights
  • Having obtained all performer authorizations
  • Owning exploitation rights or having appropriate licenses

License Granted to BraizeRecords

The client grants BraizeRecords a non-exclusive license to:

  • Distribute the works on agreed platforms
  • Promote the works (excerpts, artwork, etc.)
  • Manage neighboring rights and author rights according to the contract

7. Royalties and Payments

For distribution services:

  • Frequency : monthly, quarterly, or annual payments according to contract
  • Percentage : according to agreed pricing schedule
  • Minimum threshold : 50€ for payment (unless otherwise requested)
  • Reporting : dashboard access with real-time data

8. Client Obligations

The client commits to:

  • Provide files compliant with standards (audio quality, format, etc.)
  • Provide complete and accurate metadata
  • Respect delivery deadlines for elements
  • Inform BraizeRecords of any rights modifications
  • Not distribute the same works through other distributors without agreement

9. Termination

By the Client

The client may terminate with 3 months' notice. Content will be removed from platforms within 6 weeks after the effective termination date.

By BraizeRecords

BraizeRecords may terminate immediately in case of:

  • Non-payment
  • Copyright violation
  • Non-compliance with these Terms of Service
  • Inappropriate or illegal content

10. Liability

BraizeRecords commits to providing its services professionally but cannot be held responsible for:

  • Editorial decisions of streaming platforms
  • Commercial performance of works
  • Technical problems of third-party platforms
  • Copyright disputes initiated by third parties

11. Applicable Law and Disputes

These Terms of Service are governed by French law. In case of dispute, an amicable solution will be sought before any legal action. Failing that, the courts of Rennes will have exclusive jurisdiction.
